On 9/28th the New Berlin Common Council unanimously approved to terminate the Waste Management contract for residential waste hauling services effective 12/31/2021. This was a mutually agreed upon termination between both parties. Waste Management has agreed to utilize its best efforts to meet performance standards as set forth in the agreement for the balance of the contract.
In addition, the Council unanimously agreed to contract with Johns Disposal Service for the City’s residential garbage and recycling pickup effective 1/1/2022. This contract is contingent upon the full execution of the Waste Management termination agreement.
The City of New Berlin is also seeking liquidated damages in the amount of $49,925 as a result of the deficiencies that have occurred in the performance by Waste Management of its services to the City. This claim represents liquidated damages for incidents occurring through August 31, 2021.
